Terms of Service

The agreement between VYTONX LLC and a business using KEVOQ.

This agreement

These terms are between VYTONX LLC, registered at 30 N Gould St Ste R, Sheridan, Wyoming 82801, USA, and the business that creates a KEVOQ workspace. By creating a workspace you accept them on behalf of that business, and you confirm you are authorised to do so.

What the service is

KEVOQ answers your customers using the information you configure, captures bookings and orders, and lets your team take over a conversation at any time. It works from the services, prices, hours, policies and documents you provide.

The assistant produces language; your configuration decides the facts. Availability, prices and business hours are computed by the software from what you entered, not invented by the model. Even so, an automated reply can be wrong or can be understood differently than intended, and you remain responsible for what your business tells your customers.

Your responsibilities

  • Keep your account credentials secure, and use two-factor authentication for owner and administrator accounts.
  • Make sure you have the right to upload the material you upload, and to process the customer data you bring into the service.
  • Tell your customers that an automated assistant may answer them, where the law where you operate requires it.
  • Keep your configured information accurate. A wrong price or an out-of-date opening hour will be repeated faithfully to your customers.
  • Comply with the rules of any channel you connect, including the policies of the messaging platform that operates it.

Acceptable use

You may not use KEVOQ to:

  • Send unsolicited bulk messages, or contact people who have asked not to be contacted.
  • Impersonate another business or person.
  • Break the law where you or your customers are, or the rules of a connected messaging platform.
  • Attempt to reach another business's data, or to circumvent the separation between workspaces.
  • Present the assistant as a human being when a customer asks whether they are speaking to one.

We may suspend a workspace that is being used this way, and will say why when we do.

Your data stays yours

The information you put into KEVOQ — your configuration, your documents, your customers and their conversations — belongs to your business. VYTONX LLC uses it to operate the service for you and for nothing else. We do not sell it, and we do not use it to train models for other customers.

You can export a customer's data and erase a customer's personal details from within the product at any time, without asking us.

How we handle personal data is described in the Privacy Notice, which forms part of these terms.

Availability

We work to keep the service available and we monitor it, but we do not offer a guaranteed uptime figure and this agreement does not include a service level commitment. The service depends on providers we do not control, including the messaging platforms you connect and the provider that generates assistant replies.

We may change or withdraw features. Where a change materially reduces what the service does for you, we will tell account owners before it takes effect.

Fees

KEVOQ is not currently charged for, and no payment details are collected. If paid plans are introduced, the price, what is included, and when charging begins will be presented before anything is owed, and no existing workspace will be charged without agreeing to it first.

Ending the agreement

You may stop using KEVOQ at any time and ask us to close your workspace. We may end the agreement if these terms are breached, or if we stop offering the service, and we will give reasonable notice unless the breach makes that unsafe.

Ask us for an export before your workspace is closed. After closure we remove the workspace's data.

Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profit or lost business, or for loss arising from a decision taken on the basis of an automated reply. Nothing here limits liability that cannot be limited by law.

Changes to these terms

When these terms change in substance, the version and effective date at the top change with them, and account owners are told. Continuing to use the service after a change means accepting it.
